FindAITalents (“we,” “us,” or “our”) operates the platform at https://findaitalents.com/ (the “Site”), an AI-powered marketplace connecting businesses with top AI freelancers and professionals (the “Services”). These Terms of Service (“Terms”) govern your access to and use of the Site and Services, whether as a client, freelancer, or visitor.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must:

• Be at least 18 years old
• Have the legal capacity to enter into contracts
• Provide accurate and complete registration information
• Not be barred from using the Services under applicable law

Businesses must be duly registered and authorized to post jobs.

2. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities under your account
• Keeping your contact and payment information current

We may suspend or terminate accounts for suspected unauthorized use or policy violations.

3. User Roles

• Clients: Post projects, hire freelancers, fund escrow, approve work
• Freelancers: Create profiles, apply to jobs, deliver work, receive payments
• Visitors: Browse public content without an account

Separate Freelancer Terms apply to talent. Clients are subject to this agreement.

4. Platform Use

You agree to:

• Use the Site only for lawful purposes
• Post accurate job descriptions and deliver agreed work
• Communicate professionally and resolve disputes in good faith
• Comply with our Community Standards

You must not:

• Circumvent escrow or negotiate off-platform before contract
• Spam, harass, or discriminate
• Upload malicious code or interfere with Site functionality
• Scrape data or reverse-engineer the platform

5. AI Matching & Recommendations

We use AI to:

• Match freelancers to jobs
• Recommend opportunities
• Score profiles and applications

AI outputs are advisory. Final hiring and work decisions are yours. We do not guarantee matches or outcomes.

6. Payments & Fees

All financial transactions are governed by our Payment Policy and Refund Policy.

Service fees apply to all projects. You authorize us to deduct fees and process payments via escrow.

7. Intellectual Property

• Site Content: We own or license all platform content (logos, UI, code, AI models)
• User Content: You grant us a non-exclusive, royalty-free license to display and use your content (profiles, job posts, messages) to operate the Services
• Deliverables: Ownership transfers upon full payment and approval (per contract)

8. Privacy & Data

Your data is protected under our Privacy Policy and Cookie Policy. We use data to:

• Facilitate matching and communication
• Improve AI and platform performance
• Send transactional and marketing emails (with opt-out)

9. Disclaimers

The Services are provided “as is” and “as available.” We do not guarantee:

• Job placement or project success
• Accuracy of user profiles or AI recommendations
• Uninterrupted or error-free operation
• Security of third-party links or integrations

10. Limitation of Liability

To the fullest extent permitted by law, FindAITalents shall not be liable for:

• Indirect, incidental, or consequential damages
• Lost profits, data, or opportunitiesTotal liability capped at fees paid to us in the 6 months prior to claim

11. Termination

We may suspend or terminate your access immediately for:

• Violation of Terms
• Fraud, abuse, or illegal activity
• Non-payment or excessive disputes

You may close your account anytime via settings. Active contracts must be completed.

12. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, USA.

Disputes should first be resolved informally. Unresolved claims must be filed in Delaware courts within 1 year.

13. Changes to Terms

We may update these Terms with notice via email or in-app alert. Material changes take effect 7 days after notice.

Continued use after changes means acceptance.
