NiceFreelance ("we," "us," or "our") operates the https://beelancepro.com/ website (the "Site"), an online platform that connects businesses with top-tier freelance talent for web development, design, marketing, and other professional services (the "Services"). These Terms of Service for Freelancers ("Freelancer Terms") govern your use of the Site and Services as a freelancer.

By creating a freelancer account, applying to projects, or providing services through the platform, you agree to these Freelancer Terms, our general Terms of Service, and Privacy Policy. If you do not agree, do not use the Site or Services as a freelancer.

1. Eligibility and Account

To use our Services as a freelancer, you must:

  • Be at least 18 years old and legally capable of entering contracts
  • Provide accurate, complete profile information (skills, experience, portfolio, rates)
  • Maintain a secure account and notify us immediately of any unauthorized use
  • Comply with all applicable laws, including tax and labor regulations in your jurisdiction

We may verify your identity, skills, or background. False information may result in account suspension or termination.

2. Freelancer Responsibilities

As a freelancer, you agree to:

  • Deliver high-quality work on time, meeting client specifications and project milestones
  • Communicate professionally and respond promptly via platform messaging
  • Only apply to projects you are qualified for and can complete
  • Submit original work and respect intellectual property rights
  • Handle your own taxes, insurance, and compliance with local freelance laws
  • Not circumvent the platform (e.g., no off-platform payments or direct client contact without approval)

You are an independent contractor, not an employee of NiceFreelance or the client.

3. Project Applications and Agreements

When you apply to a project:

  • Your proposal becomes binding upon client acceptance
  • Fixed-price or hourly contracts are formed via the platform's work agreement
  • Milestones, deliverables, and revisions must be clearly defined
  • Escrow funding (for fixed-price) protects both parties

Clients may request changes; unreasonable refusals may lead to dispute resolution.

4. Payments and Fees

We facilitate secure payments through third-party processors. As a freelancer:

  • You set your rates; we deduct a service fee (disclosed per project)
  • Payments are released upon milestone approval or project completion
  • Hourly work requires time tracking via our approved tools
  • Payouts are processed weekly or on-demand (minimum thresholds apply)
  • You are responsible for any payment disputes or chargebacks

We do not guarantee payment if work is rejected for valid reasons (e.g., poor quality).

5. Intellectual Property

You retain ownership of your pre-existing IP. For project work:

  • Upon full payment, you grant the client a perpetual, royalty-free license (or full transfer if specified)
  • You warrant that your deliverables do not infringe third-party rights
  • We may use anonymized work samples for platform promotion (with your consent)

6. Ratings, Reviews, and Disputes

Both parties provide feedback post-project. You agree:

  • Reviews are public and impact your profile visibility
  • Disputes are resolved via platform mediation, escrow, or arbitration
  • Repeated low ratings may limit project access or lead to suspension

We may refund clients for undelivered or substandard work from escrow.

7. Prohibited Activities

You must not:

  • Spam applications or use bots
  • Share client contact info off-platform without permission
  • Engage in fraudulent billing or fake reviews
  • Harass, discriminate, or violate our community guidelines
  • Upload malicious code or compromise platform security

Violations may result in immediate termination and legal action.

8. Termination and Suspension

We may suspend or terminate your account for:

  • Breach of these Terms
  • Inactivity for 12+ months
  • Legal requirements or risk to the platform

Upon termination, ongoing projects must be completed or refunded via escrow.

9. Limitation of Liability

To the fullest extent permitted by law, NiceFreelance is not liable for:

  • Indirect, incidental, or consequential damages
  • Lost profits, data, or opportunities from project disputes
  • Client non-payment outside escrow

Our total liability is limited to fees paid to you in the prior 3 months.

10. Changes to These Terms

We may update these Freelancer Terms. Material changes will be notified via email or dashboard. Continued use after updates constitutes acceptance.

Note: Freelancers in the EEA/UK benefit from GDPR protections. Build a strong profile—complete verifications to access premium projects and higher visibility.
